Proposed Qualified State Interest Amendment to the Bundaberg Regional Council Planning Scheme


Notice is given under section 20 of the Planning Act 2016 and the Minister’s Guidelines and Rules that a proposed amendment to the Bundaberg Regional Council Planning Scheme is available for public consultation. The public consultation period for the proposed qualified state interest amendment commences 24 June 2022 and closes on 22 July 2022.

The purpose and general effect of the amendment is to strengthen current planning scheme provisions relating to building height, particularly for development in coastal locations within the sea turtle sensitive area. The amendment proposes a longer-term policy response to address Temporary Local Planning Instrument (TLPI) 1/2021: Protection of Sea Turtles – Bargara Building Heights for development in the High density residential zone at Bargara, the amendment also includes changes to how building height is assessed in other zones and localities across the Bundaberg Region.

Any person may make a written submission to Council about any aspect of the proposed amendment. In order for a submission to be properly made, it must:

  • be made in writing to Bundaberg Regional Council;
  • state the name and address of each person making the submission;
  • include one postal or electronic address for service relating to the submission;
  • be signed by each person making the submission;
  • state the grounds of the submission and the facts and circumstances relied on to support the grounds; and
  • be received by Council no later than 4.45pm on 22 July 2022.
